A. ACCEPTANCE OF TERMS AND CONDITIONS.

By using the website insiderdestinations.com or insiderdestinations.de ("site" or "the site" or "the website"), you, the user ("you", "user"), agree to comply with these Terms and Conditions. Insiderdestinations reserves the right to terminate your account, edit or delete your content or issue you a warning based on compliance with these Terms and Conditions, for any reason or for no reason at all, at its sole discretion, with or without prior notice. These Terms and Conditions also apply to non-registered users of the site.

B. CONDITIONS AND RESTRICTIONS ON USE.

For failure to comply with the Terms and Conditions, or if you engage in any of the following activities, Insiderdestinations may terminate your use of the Services: (a) using the Services for any unlawful purpose; (b) using the Services for any purpose prohibited by the Terms and Conditions; (c) engaging in any conduct that Insiderdestinations, in its sole discretion, believes is or may be harmful to another user or to any other party, directly or indirectly; (d) violating any German or European law or regulation; (e) using the Services in a manner that could impair, disable, overburden or damage any Insiderdestinations server, or the network(s) connected to any Insiderdestinations server, or interfere with any other party's use and enjoyment of any Services; (f) attempting to gain unauthorized access to any services, other accounts, computer systems or networks connected to any Insiderdestinations server or to any of its services, through hacking, password mining or any other means.

C. BETA CLAUSE.

This website is in its beta phase. All services are tested to the best of our abilities but are provided on an as-is basis to the sites' users.

D. PRIVACY POLICY.

We will not sell your e-mail address to third parties. We will not sell information personally identifiable to you to third parties.

We collect information from you and log it in a non-personally-identifiable way. Such information includes but is not limited to your age, location, e-mail address and IP Address. This information is either collected from you explicitly or through utilities such as cookies and beacons. This data is used to manage the website, track usage and improve our services. This non-personally-identifiable information may be shared with third parties to provide more relevant services and advertisements to members. This data is also used to compile statistics over age, home country or other criteria. These compiled statistics may be published on the website or elsewhere in a non-personally-identifiable way.

The profile information shared within your 2-degree circle are your gender, the decade you were born in, your home city, your insider cities, your personal blurb and your search tags. In your profile, you decide whether and which e-mail address to display to your 2-degree circle. Members outside your 2-degree circle can search for your name, and over the personal blurb and search tags entered in your profile.

Destination opinion text are visible exclusiveley within your 2-degree circle. Individual destination ratings are visible exclusively within your 2-degree circle. Rating averages and totals are also calculated for the entire portal and are visible to all users who have already reviewed this destination.

It is not possible for members to pay to increase the visibility scope of their circles beyond two degrees. Insiderdestinations will not publish or otherwise publicly disclose user opinions.

Destination address information is visible and editable by all users who enter reviews for this destination. In no way does this offer access to ratings and opinion text for the same destination to users more than two degrees away.

E-mail addresses entered for invitations to the site will be collected for the purposes of sending and processing the invitation and compiling related statistics in a non-personally-identifiable way. We will not sell e-mail addresses entered on the site to third parties.

None of your profile or destination information is available to users who are not registered members of the site.

Any or all information entered on the site may be accessed by technical administrators or their representatives in order to improve the services offered on the site. Any or all information entered on the site may be submitted to the proper legal authorities when required by German or European law.

D. LINKS.

Insiderdestinations contains links to external sites. Insiderdestinations is not responsible for the privacy policies or practices on external sites. When linking to another site, a user should read the privacy policy stated on that site.

E. OBLIGATIONS OF THE USER.

You are obliged to provide only true and non-misleading statements in data forms and in communications with other users, and to refrain from using pseudonyms or pen names.

You are obliged to keep your password confidential and secure and to never compromise site security.

Profile pictures must be of yourself and not of an animal, thing, other person or other creatures. By posting images onto the site, you agree to not upload pornographic images or images that breach international copyright laws.

You are obliged to comply with all applicable legislation and respect all third-party rights. In particular, you shall

not post any content that is offensive, illegal, racist or that harms, violates the rights or threatens the safety of any one person;
not unreasonably annoy (particularly with spam) any other user ;
not use the site as a platform for illegal activity or to promote religious sects or other groups banned by German law;
not promote commercial practices considered unfair competition, including but not limited to chain distribution systems, multi-level selling or pyramid schemes;
not send chain letters.

Insiderdestinations assumes no responsibility for monitoring the site for inappropriate content or conduct.

F. MEMBER INTERCHANGES.

You are solely responsible for your interactions with other insiderdestinations members. Transactions and disuptes between users as a result of their use of the site are the users' sole responsibility.

Insiderdestinations is not responsible for any incorrect or inaccurate content posted on the website or in connection with its services, whether caused by users of the site or by any of the equipment or programming associated with or utilized in the insiderdestinations services. Insiderdestinations.com is not responsible for the content, accuracy or opinions expressed on such websites, and such websites are in no way investigated, monitored or checked for accuracy or completeness by insiderdestinations. I. INDEMNITY.

You agree to indemnify and hold insiderdestinations, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the insiderdestinations services in violation of these Terms and Conditions and/or arising from a breach of these terms and/or any breach of your representations and warranties set forth above and/or if any content that you post on the insiderdestinations website or through the insiderdestinations Services causes insiderdestinations.com to be liable to another.

J. CHANGES.

Insiderdestinations reserves the right to modify the services offered on the insiderdestinations websites and to offer services different from those offered at the time of the user's registration.

K. FINAL PROVISIONS.

Insiderdestinations reserves the right to amend these Terms and Conditions at any time, without giving reasons, unless an amendment is unreasonable to you. Insiderdestinations shall give you due notice of any amendments of these Terms and Conditions. If you do not object to the applicability of the revised Terms and Conditions within two weeks after receipt of said notice, the amended Terms and Conditions shall be deemed to be accepted by you. Insiderdestinations shall inform you about your right to object and of the relevance of the objection deadline in said notice.

If any provision of these Terms and Conditions is, for any reason, invalid and/or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. The parties agree to replace an invalid and/or unenforceable provision with a valid and/or enforceable provision which most closely approximates the intent and economic effect of the invalid and/or unenforceable provision. This also applies to contractual loopholes.

The place of performance under these Terms and Conditions shall be Germany. The place of jurisdiction, insofar as legally admissible, shall be Germany.

These Terms and Conditions and the contractual relationship they represent shall be governed by German Law, excluding international private law and the provisions of the United Nations Convention on Contracts for the International Sale of Goods that have been adopted by German Law.

The disclaimers and liability limitations for insiderdestinations expressed in these Terms and Conditions apply to insiderdestinations' owners and management.
